Terms of Service

1. Purpose

These terms of service (the "Terms") set out the terms of access to and use of the baskio service, a meal-planning and automatic drive-through grocery cart-filling service, operated primarily via WhatsApp. Any use of the service constitutes full and unconditional acceptance of these Terms.

2. Service publisher

The baskio service is published by Baby Sittor SAS, a French simplified joint-stock company (SAS) registered with the Bordeaux Trade and Companies Register under SIREN number 810 288 811 (SIRET 810 288 811 00039), with share capital of €2,595. Its registered office is located at 19 rue du Sacré-Cœur, 33000 Bordeaux, France. Its intra-community VAT number is FR79810288811 and its NAF code is 58.19Z.

The company is chaired by FREYR, a French SARL (limited liability company) with capital of €1,127,165 (SIREN 931 953 483, SIRET 93195348300019, NAF 66.30Z), managed by Maxence Coisne.

3. Access to the service

Access to the baskio service is via sign-up through WhatsApp. A valid phone number is required to create an account and use the service. The service is currently in a testing phase. Access may be limited, suspended or modified at any time without notice during this period.

4. Description of the service

The baskio service generates personalised weekly menus, tailored to the composition of the user's household, dietary restrictions, culinary preferences and budget. The service also automatically fills the grocery cart with the drive-through retailer chosen by the user.

Before any cart is confirmed, the user receives a summary notification allowing them to review the contents of their cart. The user can change their menus, preferences and cart contents at any time.

5. User responsibility

The user agrees to provide accurate, up-to-date information when signing up and throughout their use of the service. It is the user's responsibility to keep their drive account login credentials secure and not to share them with anyone other than the baskio service.

The user agrees to fully disclose all food allergies, intolerances and restrictions, whether medical, religious or personal in nature. It is the user's responsibility to systematically check the contents of their cart before proceeding to payment with their drive-through retailer.

6. baskio's responsibility

The baskio service is subject to a best-efforts obligation, not an obligation of result. baskio commits to using all reasonable means to provide a reliable, quality service, without however guaranteeing the complete absence of errors or interruptions.

baskio does not make any payments on behalf of the user. Final cart confirmation and payment are the sole responsibility of the user with their drive-through retailer. baskio does not guarantee the availability of selected products at the user's retailer. Suggested substitute products are provided for guidance only and do not constitute any form of commitment.

7. Special needs and allergies

The user must fully and accurately declare all food allergies, intolerances and restrictions at sign-up and keep them up to date throughout their use of the service. baskio uses its best efforts to take these declarations into account when generating menus and selecting products.

However, baskio cannot guarantee the complete absence of allergens in suggested products. Product composition may vary by manufacturer and production batch. It is the user's responsibility to systematically check the composition of products in their cart, in particular allergen labelling, before consumption.

8. Supermarket account credentials

The user's drive account login credentials are encrypted using the AES-256 standard via the Fernet protocol as soon as they are received. They are used exclusively to automatically fill the user's grocery cart and are never stored in plain text.

The user may request immediate deletion of their credentials at any time by sending a request by email or via the dedicated command on WhatsApp.

9. Intellectual property

All elements that make up the baskio service, including without limitation the source code, design, text, graphics, logos, icons and algorithms, are the exclusive property of Baby Sittor SAS and are protected under French and international intellectual property law. Any reproduction, representation, modification or use, in whole or in part, of these elements without the prior express authorisation of Baby Sittor SAS is prohibited.

10. Personal data

Processing of the user's personal data is governed by our privacy policy, available at /en/privacy. Users are encouraged to review it to understand how their data is collected, processed and protected.

11. Changes to these Terms

Baby Sittor SAS reserves the right to modify these Terms at any time. In the event of a material change, the user will be notified via WhatsApp. Continued use of the service after notification of changes constitutes acceptance of the new Terms. If the user does not accept the changes, they may close their account in accordance with Article 12 below.

12. Termination

The user may delete their account and stop using the service at any time, without notice and free of charge, by sending the command /delete on WhatsApp or by emailing maxence@babysittor.com. Deleting the account immediately ends access to the service and starts the data retention period as defined in the privacy policy.

13. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute relating to the interpretation, performance or termination of these Terms, and failing an amicable resolution, the courts of Bordeaux shall have exclusive jurisdiction.
